US President Donald Trump was banned on Saturday by the country’s Supreme Court from using the 1798 Foreign Enemies Act to deport Venezuelans for an El Salvador prison.
The decision was attended by seven of the nine court magistrates and is temporary – its validity extends until the case is permanently analyzed.
“The government is instructed not to remove any member of the alleged class of detainees from the United States to the new order of this Court,” the sentence says.
The law in question has been used by the Republican to support the deportation of 238 immigrants from the Latin American country, without having the right to appeal, on their accusation allegedly being part of a criminal organization.
Family members of immigrants deported under this law deny the accusations and the government of Venezuela appealed to the United Nations Human Rights Council against deportations.
On April 7, the US Supreme Court authorized the use of the law as long as immigrants had the right to contest deportation. However, human rights organizations appealed to the courts claiming that the Trump government was not respecting the decision.
The government of El Salvador, which has been governor for three years through state -of -the -art decrees, has received prisoners sent by the US in exchange for financial aid and “intelligence” of the Trump administration.
The El Salvador Terrorist Confinement Center (Cecot), known as the largest prison in Latin America, built by President Nayib Bukele, is the subject of allegations of human rights violations with systematic torture practice, including children, and for not granting suspects for rights to mass defense and judgment.
