The president of the Federal Supreme Court (STF), minister Luiz Edson Fachin, reacted this Saturday (25) to the statements made by the president of Argentina, Javier Milei, against minister Alexandre de Moraes. In an official note, Fachin classified the statements as a “disrespectful reference” to a member of the Supreme Court, reaffirmed the independence of the Brazilian Judiciary and stated that demonstrations like this are “incompatible with the civility that should characterize relations between States”.
The demonstration was announced just hours after Milei participated in the PL national convention, in Brasília, where he declared support for the presidential candidacy of senator Flávio Bolsonaro (PL-RJ). During the speech, the Argentine president criticized STF decisions involving former president Jair Bolsonaro, stated that there are ministers who behave like “dictators” and classified Alexandre de Moraes’ decision that prevented him from visiting Bolsonaro as unfair.
In the note, Fachin makes it clear that the criticism affected not just a minister, but the institution itself. “This is a disrespectful reference to a judge from the highest court in the country”, wrote the president of the STF when commenting on the statements made by Milei in Brazilian territory.
The president of the Supreme Court also defended the legality of Moraes’ decision. According to him, the jurisdictional act criticized by the Argentine president was carried out “in accordance with the Constitution and laws of the Federative Republic of Brazil”. The excerpt seeks to reinforce that the questioned decision arises from the constitutional powers of the Supreme Court and does not represent arbitrary action, as Milei suggested in his speech.
Fachin also emphasized that the STF maintains “the full autonomy of the Brazilian Judiciary”, in a direct response to criticism from a foreign head of state. The statement reinforces that the Court’s decisions are taken independently and without external interference.
The most striking part of the statement appears at the end of the note. When condemning Milei’s statements, the president of the Supreme Court stated that the Court “deplores demonstrations that are incompatible with the civility that must characterize relations between States”. The reference takes the answer beyond the legal field and also places the episode on a diplomatic level, indicating that the Argentine president’s behavior went beyond the limits expected in institutional relations between countries.
Milei’s statements took place during one of the main events of Flávio Bolsonaro’s campaign. In addition to defending Jair Bolsonaro, the Argentine president once again attacked the government of President Luiz Inácio Lula da Silva, criticized what he called the advance of socialism in Latin America and stated that a victory for Flávio Bolsonaro would represent a change of direction for Brazil.
The response signed by Fachin transforms the episode into an institutional manifestation of the Federal Supreme Court. Instead of an individual reaction from Alexandre de Moraes, the Presidency of the Court assumed the public defense of the minister’s actions and the independence of the Brazilian Judiciary in the face of criticism made by a foreign president on national soil.
